“The development of the distinction between real and personal rights in South African case law: A critical perspective”.


Mrs Marda Horn from the Department of Private Law delivered a paper at the fourth annual Young Property Lawyers’ Forum that was held at the Institute for Property Law at the University of Leuven, Belgium, from 25 to 27 November 2013.


The paper dealt mainly with the development of the distinction between real and personal rights in the South African case law, with specific reference to the so-called 'subtraction from the dominium test' that is currently employed in South Africa as a mechanism for drawing this distinction.
