Private Law Overview

Private Law governs the legal relationships between persons and covers aspects such as legal status, family relationships, property, contracts, succession, and delict. The Department of Private Law offers the following modules within the Bachelor of Laws (LLB) degree:

LLB Module

Family Law

Engagements, marriage frameworks, matrimonial property systems, divorce principles, child maintenance, and custody laws.

LLB Module

Law of Persons

Legal subjectivity, its origin and status, determining when the law recognises legal capacity to conclude transactions.

LLB Module

Law of Succession & Estate Administration

Wills and testaments, testate and intestate inheritance laws, and the legal administration of deceased estates.

LLB Module

Law of Property

Distinctions between legal possession and ownership, and constitutional frameworks governing property rights.

LLB Module

The Law of Delict

Negligent or purposeful causation of damage, civil liability, and legal remedies available to wronged parties.

LLB Module

The Law of Contract

Foundational principles of legal agreements, contract formation, breach, and extensive preparation for litigation practice.

Further Fields

Encompassed Legal Disciplines

Enrichment, Estoppel, Road Accident Fund frameworks, Sectional Title structures, the Law of Damages, and the Law of Trusts.

Mission

The department distinguishes itself through these main pillars:

Teaching: Effectively preserving the balance between entrenching theoretical principles and conveying the requirements of legal practice to deliver well-rounded students.

Research: Conducting research into topical, relevant discipline-specific issues published in textbooks and leading journals, and conveyed through papers and teaching.

Community: Serving the community optimally in strict compliance with its social responsibility objectives.

Vision

The department strives to provide an active learner-centred teaching environment that is founded on leading research and makes a positive contribution to the development of its students and the community.

Private law governs the relationship between persons and therefore covers societal aspects such as births and deaths, marriages, contracts, property, succession, and wrongful acts.

Through its research activities the department strives to remain at the forefront of the constant changes occasioned by a rapidly developing legal system.

In addition to the full-time staff, our department is also fortunate to have a number of honorary and extraordinary professors who serve as part-time academic staff.
